How to renew a Trademark
A trademark registration is valid for a period of 10 years, after which it must be renewed in order to maintain its validity. The Indian Trademark Office will send a reminder letter to the trademark holder 6 months before the expiration date.
When renewing a trademark, there are two options: keep the trademark as is or make changes and alterations to it.
The form to file for renewal is called TM-R and it can be filed by the registered owner or by an authorized representative or agent. After filing, it’s important to monitor the status of the application in case of any oppositions raised by the public. If the application is approved, the trademark will be published in the Official Gazette and the trademark holder will be protected for an additional ten years.
Trademarks can be renewed indefinitely and the cost for renewal varies depending on whether it’s done in-person or online, with the latter being less expensive.

- Copy of form TM-A (form used for the original application for registering the trademark) Or Registration Certificate Or Application Number
- ID and address proof of the applicant
- Power of attorney if the applicant is an authorised representative or an agent
Restoration of Trademark
If a person forgets to renew their trademark within the designated time period, there is still an option available to them. This option is called trademark restoration, which is allowed under Section 25(4) of the Trademark Act, 1999. This allows individuals to apply for the restoration of their trademark within one year of its expiration. Restoration of a trademark incurs an additional fee over the renewal fee, which is 10,000 rupees if done in-person or an additional 9000 rupees if done online.
